Constitutional Connection
The right to choose is not straight forward and in the constitution. To prove that the bill of rights protects the right to choose, you have to pull information from many different amendments. Through much research, people have found a way to protect the right to receive an abortion by taking parts of different amendments to prove that it is protected by the constitution. The first thing protected by the bill of rights is the privacy zone. It has been found that the privacy zone is protected in the 1st, 3rd, 4th, 5th, and 9th amendments. Therefore, according to the bill of rights, a woman has the right to privacy which means she has the right to her body and making decisions without the consent of a court if the abortion is within a certain time period. In the 5th and 14th amendment, something called due process helps protect to right to choose. Due process is "based on the principle that a person cannot be deprived of life or liberty or property without appropriate legal procedures and safeguards"(Due Process). In other words, a human has the right to life. Also in the 14th amendment there is the definition of a person helps determine whether abortion should be legal or not.
